WHEREAS, the Indian Nations and Tribes have long sought to establish an open dialogue with the government of the State of Washington concerning areas of overlap or conflict of jurisidiction as one government to another; and WHEREAS, without such dialogue on many existing conflicts, adversary proceedings have been initiated before Federal courts. Such court proceedings are time- consuming and costly to both the State government and the Indian Governments. NOW THEREFORE BE IT RESOLVED, that the delegated representatives to the Sixth Session of the Conference of Tribal Governments pledge, on behalf of their respective governments, the continuing responsible exercise of civil and criminal jurisdiction in accordance with tribal laws dully enacted by the respective governments, and the delegates sincerely urge the Executive Officer of the Washington State Government to continue the official policy of his predecessors to actively advocate, encourage and promote State legislation to retroceed the State's claim to jurisidiction within the boundaries of Indian Nations and Tribes on the basis of bi-lateral consent between the State of Washington and specific Indian Governments concerned. BE IT FURTHER RESOLVED, that the delegates to the Sixth Session of the Conference of Tribal Governments do recognize that where uncertainty over an area of jurisidiction or where overlap of jurisdictions between the State and Indian Nations occur it is both desirable and appropriate that bi-lateral or multi-lateral, government-to-government negotiations serve as the proper method for resolving such disputes; and BE IT FURTHER RESOLVED, that the representatives of Indian Governments do declare the willingness of their governments to enter into multi-lateral discussions with the State of Washington to formulate a mutually acceptable framework for the future resolution of jurisdictional conflicts which includes procedures, principles and guidelines for the resolution of conflicts on a government-to-government basis; and BE IT FURTHER RESOLVED, that where no immediate agreement can be reached on a mutually acceptable framework for the future resolution of jurisdictional conflicts, the heads of Indian Governments declare their commitment to maintain open and free lines of communications to enable continuation of negotiations; and BE IT FINALLY RESOLVED, that the delegates to the Sixth Session of the Conference of Tribal Governments declare on behalf of their respective governments a continuing commitment to the principles of mutual respect and cooperation between governments to achieve workable intergovernmental agreements to resolve jurisdictional disputes between Indian Governments and the Government of the State of Washington. -=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=- To have a current Center For World Indigenous Studies Publication Catalogue sent to you via e-mail, send a request to jburrows@halcyon.com Center For World Indigenous Studies P.O.
